MANILA, Philippines — The Sandiganbayan has affirmed the graft conviction of five former officials of the Philippine National Police in connection with the ghost repair and procurement of spare parts for the PNP’s armored vehicles from 2007 to 2008.
In a resolution promulgated on March 16, the anti-graft court’s Special Fourth Division denied the motions for reconsideration of the respondents.
The Sandiganbayan upheld its ruling, which found them guilty of four counts of violation of the Anti-Graft and Corrupt Practices Act.
The court had sentenced them to up to 10 years in prison for each count of the offense, for a total of up to 40 years.
They are former PNP Logistics Support Service-Bids and Awards Committee chairman Col. Emmanuel Ojeda, former vice chairman Col. Reuel Leverne Labrado, former assistant chief for Administrative and Resources Management Division and LSS purchasing officer Lt. Col. Josefina Dumanew as well as LSS BAC members Maj. Analee Forro and M/Sgt. Victor Puddao.
Also found guilty of graft were former LSS inspection officer Lt. Col. Warlito Tubon, non-uniformed personnel supply accountable officer Eulito Fuentes for two counts of graft as well as former LSS BAC member Lt. Col. Henry Duque and former property inspector for the Directorate for Comptrollership Alex Barrameda for one count each.
They were perpetually disqualified from holding public office.
The cases stemmed from the anomalous transactions amounting to P397.58 million for the repair and maintenance of 28 V-150 light armored police vehicles.
The court ruled that the mandatory bidding procedures had been bypassed.
The PNP officials made it appear that they purchased spare parts, engines and transmission assemblies for the repair and maintenance of the vehicles.
The court said the PNP officials, in collusion with the suppliers, falsified documents such as the invitation to bid, minutes of bidding, recommendation of award, purchase order, delivery receipts as well as certifications of inspection.
