MANILA, Philippines — The labor department demanded a total of P11.4 million in labor-related fines and administrative liabilities from the owner and contractor of the collapsed nine-story building under construction in Angeles City, Pampanga.
The Department of Labor and Employment ordered Jackson Lim, the owner, and Golden Years Construction and Steelworks Corp., the contractor, to pay P1,102,798 for labor standards violations and P10,324,000 in administrative fines for violating Republic Act No. 11058, or the Occupational Safety and Health Standards (OSHS) Act.
Unsafe working conditions
According to the agency’s investigation, several labor and safety violations were committed by both the owner and the contractor, which eventually led to the collapse of the building and the deaths of 30 workers.
The labor agency’s investigation found that the victims were killed due to unsafe working conditions.
Among the safety violations cited by the agency were the lack of personal protective equipment and the temporary accommodations provided to workers.
Apart from these, the owner and contractor also submitted fake certificates for designated health personnel and safety officers at the construction site.
Previous reports on the incident stated that the workers were sleeping inside the building when it collapsed in the early hours of May 24.
A work stoppage order had been issued for the construction project, but the workers continued to work, the agency added.
Underpaid. Aside from dangerous working conditions, the construction workers were also subjected to unfair labor practices.
Labor Secretary Francis Tolentino said the workers did not receive proper wages, benefits and compensation for work rendered during rest days and holidays.
Meanwhile, Tolentino said an official and certain labor inspectors from DOLE Regional Office III will also face administrative cases for failing to properly implement labor laws.
“DOLE found gaps in the implementation of labor laws. Hence, we will continue with the administrative proceedings against an official and certain labor inspectors of DOLE Regional Office III,” Secretary Tolentino said.
