The SC has affirmed a Court of Appeals decision that found an engineer working at the Muntinlupa City government guilty of grave misconduct for testing positive for shabu twice.

MANILA, Philippines — Government employees who test positive for illegal drug use must first be given a chance to undergo rehabilitation, the Supreme Court (SC) has declared, saying that drug use and the resulting addiction or dependence is not a crime but a sickness that requires treatment.
The SC has affirmed a Court of Appeals decision that found an engineer working at the Muntinlupa City government guilty of grave misconduct for testing positive for shabu twice.
The high court had suspended the penalties and ordered the engineer’s retesting.
If he tests negative, no treatment will be required and the Civil Service Commission may reassess the release of his benefits and eligibility for future public service.
However, if he tests positive again, he must undergo a drug dependence exam and enter an intervention program.
The SC said the CSC will reassess the engineer’s status “once certified fully rehabilitated and fit to work by his doctor.”
“Dismissal may only be considered if they refuse to cooperate or fail the intervention program,” the high tribunal said.
