MANILA, Philippines – Kung gugustahin ba ng Senado, puwede ba nitong suwayin ang Supreme Court decision na nagpahinto sa impeachment trial ni Vice President Sara Duterte?

Pahiram ng ilang minuto at pag-usapan natin in detail.

‘Di ba nga, may SC decision na nagsasabing unconstitutional daw ‘yong articles of impeachment na ginamit laban kay Vice President Sara Duterte? Kaya hinto na ang trial.

At this point, ang option for the House ay mag-file ng motion for reconsideration para i-apela ‘yong desisyon ng Korte Suprema. Gagawin naman ito ng House.

Pero, may hinihintay rin na major move from the Senate. Kahit nagdesisyon na ang Supreme Court na walang trial ang puwedeng maganap against the Vice President this year ay may arguments na puwedeng suwayin ito ng Senado.

Ang dahilan, under the Constitution kasi, ang House ang may power to impeach. Samantalang ang Senate naman ang may sole mandate to try and decide impeachment cases.

Tapos, ang isa pang argument ay co-equal branches ang Supreme Court at ang Senate. Walang mas mataas o walang mas mababa sa dalawa.

At the end of the day, nasa Senado mismo kung ano ang gusto nitong gawin because independent body ito.

For our part, two scenarios lang ang aabangan natin. First scenario, kung gagalangin ng Senate ang SC decision, eh di ‘di na talaga matutuloy ang trial. Second scenario, kung hindi gagalangin ng SC decision, eh di magpapatuloy ang trial.
